Naper Doodles Contract & Health Warranty SAMPLE of PURCHASE CONTRACT & HEALTH WARRANTY FOR CANINE PET This contract is between Natasha Miller (Breeder) and ___________________ (Customer) It is agreed between Breeder and Customer(s) as follows:
DESCRIPTION OF DOG PURCHASE & DELIVERY SCHEDULE · Upon application approval, a non-refundable $250 deposit will secure Customer’s placement on the waiting list for a Miniature F1B Labradoodle. Deposit is applied towards the full purchase amount of a puppy. The full purchase price is the sum of $2000.00. · When the litter is whelped, Naper Doodles will notify Customer of availability. Breeder shall select the puppy in consultation with Customer based on their stated preferences. If a puppy from the litter is assigned to Customer then payment of the remainder of the purchase price together with the signed contract shall be delivered to Naper Doodles by the time the puppy is six (6) weeks of age. This fee does not include shipping, if shipping is required. Failure to return final payment and signed contract may, at Naper Doodles’ option, result in puppy being offered to another family. In this event, the $250 deposit may be retained by Naper Doodles at its sole option as liquidated damages and not as a penalty or forfeiture. The parties agree that it would be difficult to ascertain the exact amount of Naper Doodles’ damages in advance and they do hereby stipulate and agree that said $250.00 represents a reasonable estimate of damages. · If the litter does not produce enough puppies to provide Customer with the color and/or sex they requested then the deposit will be applied toward a future litter while maintaining the same Customer requests (color, gender). · Puppy will be de-sexed (spayed or neutered) at seven (7) weeks of age. Naper Doodles guarantees the puppy will arrive to the Customer current on vaccinations and de-worming appropriate to age. Puppy will have microchip implanted and all necessary paperwork will be provided to activate the microchip number. Naper Doodles will also provide a Health Certificate by a veterinarian licensed in Illinois. · Puppy can be picked up by Customer in Naperville, IL, at eight (8) weeks of age. If Customer chooses to have puppy shipped, additional shipping costs must be paid in full prior to puppy leaving Breeder’s possession. The shipping fee is $300 and covers transportation to the airport, air fare, travel crate, vet check and health clearance for flight. Naper Doodles will work with Customer to establish a shipping date acceptable to both parties. · If you are coming to pick up your puppy, Naper Doodles is able to care for your puppy up to nine (9) weeks of age without a charge. After nine weeks of age, a $12 daily care fee will be charged to Customer. · Naper Doodles reserves the right to cancel a purchase and refund deposit at any time prior to Customer taking possession of the puppy if it becomes apparent that Customer will not be able to provide a quality home as determined by Naper Doodles in its sole discretion.
INITIAL EXAMINATION
HEALTH GUARANTEE (FIVE DAY) · Should puppy be found by a veterinarian to have a health issue during initial exam, Customer has the option to return the puppy for a full refund of the purchase price OR to have Naper Doodles reimburse Customer for proven veterinary expenses to correct the problem up to the purchase price of the puppy. · The Breeder must be informed of any sign of illness in the puppy as soon as it occurs and will not provide reimbursement for expenses incurred without the Breeder’s prior approval. · The examination cost is the responsibility of the Customer. Written proof of examination and problem diagnosis by a veterinarian must be provided to Naper Doodles. Any request for full refund or veterinary expense reimbursement must be made within the 5 DAY period allotted. · Breeder will not reimburse for fleas or ticks that the puppy could acquire after it leaves Naper Doodles. Customer RESPONSIBILITY · A puppy’s immunity is not strong enough to be exposed to potentially deadly viruses (such as parvovirus) before the puppy vaccinations are complete. During the time between receiving your puppy and the completion of puppy shots (approximate age of 16 weeks), it is Customer’s responsibility to keep the puppy away from public places including, but not limited to, pet stores, puppy kindergarten, Doodle Romps and parks. · Puppy will have received vaccinations appropriate to their age before transfer of ownership (typically 8 weeks of age). In addition to the initial examination, Customer must ensure that puppy also receives immunizations at 12 weeks and 16 weeks of age and annual immunizations thereafter. · Customer is responsible to care for the dog as a companion pet with quality food, exercise, indoor living quarters, reliable fence, and regular veterinarian care. · Customer is responsible to keep the dog fit and not allow the dog to become overweight, as this may contribute to hip dysplasia. The puppy should not participate in strenuous or repetitive jumping exercise (such as Frisbee jumping) in the first year of life as such activity can be detrimental to bone development and can contribute to hip dysplasia. · Customer is responsible for properly training and socializing their puppy. This includes teaching the puppy obedience and manners (no nipping, chewing, barking etc). Should Customer have difficulties training their puppy, they agree to hire a certified, professional trainer to assist them.
GENETIC HEALTH GUARANTEE (TWO YEAR) Naper Doodles provides a warranty for two (2) years after the date of birth of the dog against any serious genetic disorder that affects the dog’s quality of life or expected lifespan. Should a genetic disorder be discovered, the Breeder will reimburse Customer the veterinary costs up to the purchase price of the dog OR provide a replacement puppy to Customer from a similar litter type from first litter with availability. We reserve the right to have a veterinarian of our choice confirm the results before a replacement or refund is provided. Naper Doodles does not require return of your canine companion. In the case of Hip Dysplasia (HD), Customer must provide documentation from PennHIP or OFA proving the dog will suffer from the genetic problem. The guarantee against HD will be terminated should dog be allowed to become overweight (through vet records) or if X-Rays indicate physical trauma that caused or contributed to the issue. For problems not relating to HD, two independent veterinary examinations and reviews must be provided to Naper Doodles documenting the genetic health issue. Reimbursement of veterinary fees will be provided to Customer once copies of the medical reports are received by Breeder. Reports must state the treatments provided, and fees for the treatments. A diagnosis of progressive retinal atrophy requires the report of a certified veterinary ophthalmologist.
RE-HOMING We strongly urge that you contact Naper Doodles should it ever become necessary to re-home this dog. Naper Doodles will either assist in re-homing the dog, or has the option of taking the dog back and paying Customer 50% of the initial purchase price. Under no circumstances will a refund be made because a dog did not fall within a size category or coat type. Although all attempts are made to accommodate your 'cosmetic' request, health and temperament are primary. Customer agrees to never relinquish the dog to an animal shelter, rescue organization or puppy mill.
LIMITATIONS OF CONTRACT This contract may not be assigned by the Customer and the guarantees and warrantees of this Agreement shall not be transferable. Transfer of ownership of canine listed above shall take place upon delivery of puppy from Naper Doodles to Customer. Upon transfer of ownership all veterinary care and its associated costs are the sole and exclusive responsibility of Customer. We reserve the right to retain puppies from our litters for use within our own program or as payment for stud service.
